Bill Title: Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that if a consumer purchases merchandise, it is an unlawful practice for the seller of the merchandise to enroll the consumer in a "club" or group whereby the consumer will periodically receive from the seller or another person shipments of similar merchandise not ordered or otherwise expressly requested by the consumer, unless the consumer expressly agrees in writing to be enrolled in the "club" or group and receive such periodic shipments of merchandise. Effective immediately.

1 AN ACT concerning business.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2III as follows:
6 (815 ILCS 505/2III new)
7 Sec. 2III. Seller's shipments of similar merchandise to
8 consumer. If a consumer purchases merchandise, it is an
9 unlawful practice under this Act for the seller of the
10 merchandise to periodically send and debit the consumer's
11 account for shipments of similar merchandise, unless the
12 consumer has agreed, by express request or consent, to receive
13 such periodic shipments of merchandise. The seller must clearly
14 and conspicuously disclose any minimum purchase requirement
15 and how the consumer may cancel periodic shipments.
16 Section 99. Effective date. This Act takes effect upon
17 becoming law.
