1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Controlled Substances Act is
5amended by changing Section 407.2 as follows:
6 (720 ILCS 570/407.2) (from Ch. 56 1/2, par. 1407.2)
7 Sec. 407.2. Delivery of a controlled substance to a
8pregnant woman.
9 (a) Any person who violates subsection (a) of Section 401
10of this Act by delivering a controlled substance to a woman he
11knows to be pregnant may be sentenced to imprisonment for a
12term twice the the maximum amount authorized by Section 401 of
13this Act.
14 (b) Any person who delivers an amount of a controlled
15substance set forth in subsections (c) and (d) of Section 401
16of this Act to a woman he knows to be pregnant commits a Class 1
17felony. The fine for a violation of this subsection (b) shall
18not be more than $250,000.
