Bill Title: Amends the State Library Act. Provides that the term "publication" does not include reports, documents, or other publications of a public institution of higher learning, except to the extent that the State Librarian, by rule, requires the report, document, or publication to be deposited with the State Library. Effective immediately.

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The State Library Act is amended by changing
5Section 21 as follows:
6 (15 ILCS 320/21) (from Ch. 128, par. 121)
7 Sec. 21. Publications and lists; deposits by State
8agencies.
9 (a) All State agencies shall provide and deposit with the
10Illinois State Library sufficient copies of all publications
11issued by such State agencies for its collection and for
12exchange purposes. The State Librarian shall by rule or
13regulation specify the number of copies required and the
14publications that must be deposited. The number of paper
15copies of a publication that must be deposited may be reduced
16if the documents are also submitted in an electric format
17specified by the Illinois State Library. The State Librarian
18shall set by rule the standard to be used for electronic data
19exchange among State agencies and the State Library.
20 (b) For the purposes of this Section:
21 "State agencies" means every State office, official,
22department, division, section, unit, service, bureau, board,
23commission, committee, and subdivision thereof of all branches

1of the State government and which agencies expend
2appropriations of State funds.
3 "Publications" means any document, report, directory,
4bibliography, rule, regulation, newsletter, pamphlet,
5brochure, periodical or other printed material paid for in
6whole or in part by funds appropriated by the General Assembly
7or issued at the request of a State agency, excepting however,
8correspondence, inter-office memoranda, and confidential
9publications. "Publications" does not include reports,
10documents, or other publications of a public institution of
11higher learning, except to the extent that the State
12Librarian, by rule, requires the report, document, or
13publication to be deposited with the State Library.
14 "Published material" means publications in print and
15electronic formats duplicated by any means of duplication,
16including material downloaded from a publicly accessible
17electronic network.
18 (c) The State Librarian shall from time to time provide a
19listing, electronically, in printed form, or in both formats,
20of the publications received by him or her under this Act.
