1 AN ACT concerning propane sellers.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2NNN as follows:
6 (815 ILCS 505/2NNN new)
7 Sec. 2NNN. Sales practices of propane sellers.
8 (a) As used in this Section:
9 "Calendar week" means a period of 7 consecutive days
10 beginning with Sunday and ending with Saturday.
11 "Propane" means a hydrocarbon whose chemical
12 composition is predominately C3H8, whether recovered from
13 natural gas or crude oil, and includes liquified petroleum
14 gases and mixtures thereof.
15 "Propane seller" means a person engaged primarily in
16 the sale of odorized propane to the ultimate consumer by
17 delivery to and filling of the consumer's propane storage
18 device at the consumer's place of consumption.
19 (b) A propane seller may not sell and deliver propane at
20different prices to different consumers with respect to sales
21made during the same calendar week.
22 (c) A violation of this Section constitutes an unlawful
23practice within the meaning of this Act.
