Bill Title: Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that on and after July 1, 2009, the Department of Healthcare and Family Services may not expand the Children's Health Insurance Program (KidCare and FamilyCare), the Covering ALL KIDS Health Insurance Program, or the medical assistance (Medicaid) program by any means, including, but not limited to, (i) applying for waivers of federal law and regulations to cover additional services or groups of persons, (ii) increasing income eligibility limits or otherwise expanding the number of persons covered under the programs, or (iii) increasing the number or types of services covered under the programs. Effective immediately.

Amends the Children's Health Insurance Program Act, the Covering ALL KIDS Health Insurance Act, and the Illinois Public Aid Code. Provides that on and after July 1, 2009, the Department of Healthcare and Family Services may not expand the Children's Health Insurance Program (KidCare and FamilyCare), the Covering ALL KIDS Health Insurance Program, or the medical assistance (Medicaid) program by any means, including, but not limited to, (i) applying for waivers of federal law and regulations to cover additional services or groups of persons, (ii) increasing income eligibility limits or otherwise expanding the number of persons covered under the programs, or (iii) increasing the number or types of services covered under the programs. 1 AN ACT concerning health.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Children's Health Insurance Program Act is
5 amended by adding Section 65 as follows:
6 (215 ILCS 106/65 new)
7 Sec. 65. No expansion of program. On and after July 1,
8 2009, the Department may not expand the Children's Health
9 Insurance Program by any means, including, but not limited to,
10 (i) applying for waivers of federal law and regulations to
11 cover additional services or groups of persons, (ii) increasing
12 income eligibility limits or otherwise expanding the number of
13 persons covered under the program, or (iii) increasing the
14 number or types of services covered under the program.
15 Section 10. The Covering ALL KIDS Health Insurance Act is
16 amended by adding Section 70 as follows:
17 (215 ILCS 170/70 new)
18 Sec. 70. No expansion of program. On and after July 1,
19 2009, the Department may not expand the Covering ALL KIDS
20 Health Insurance Program by any means, including, but not
21 limited to, (i) applying for waivers of federal law and

1 regulations to cover additional services or groups of persons,
2 (ii) increasing income eligibility limits or otherwise
3 expanding the number of persons covered under the program, or
4 (iii) increasing the number or types of services covered under
5 the program.
6 Section 15. The Illinois Public Aid Code is amended by
7 adding Section 5-27 as follows:
8 (305 ILCS 5/5-27 new)
9 Sec. 5-27. No expansion of program. On and after July 1,
10 2009, the Department of Healthcare and Family Services may not
11 expand the medical assistance program under this Article by any
12 means, including, but not limited to, (i) applying for waivers
13 of federal law and regulations to cover additional services or
14 groups of persons, (ii) increasing income eligibility limits or
15 otherwise expanding the number of persons covered under the
16 program, or (iii) increasing the number or types of services
17 covered under the program.
18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
