2 | AMENDMENT NO. ______. Amend Senate Bill 3301 on page 1, | ||||||
3 | line 5, after "40", by inserting "and adding Section 22"; and

4 | on page 1, immediately below line 5, by inserting the | ||||||
5 | following:

6 | "(215 ILCS 121/22 new) | ||||||
7 | Sec. 22. Criminal history record
check; application for | ||||||
8 | certificate and certificate renewal. | ||||||
9 | (a) For the purpose of this Section, "fingerprints" means | ||||||
10 | an impression of the lines on the finger taken for the purpose | ||||||
11 | of identification. The impression may be electronic or in ink | ||||||
12 | converted to electronic format, with an identity verification | ||||||
13 | method authorized by the Department of State Police and the | ||||||
14 | Department of Financial and Professional Regulation. | ||||||
15 | (b) In order to make a determination of certification | ||||||
16 | eligibility, the Director is authorized to require all |

1 | applicants for certification to undergo a fingerprint-based | ||||||
2 | criminal history record check for an initial certification and, | ||||||
3 | for an individual holding a certificate on the effective date | ||||||
4 | of this amendatory Act of the 98th General Assembly, for the | ||||||
5 | first renewal of a certificate. Each navigator applying for | ||||||
6 | certification or renewal shall submit his or her fingerprints | ||||||
7 | to the Department of State Police in the form and manner | ||||||
8 | prescribed by the Department of State Police. The fingerprints | ||||||
9 | should be transmitted through a live scan fingerprint vendor | ||||||
10 | licensed by the Department of Financial and Professional | ||||||
11 | Regulation. The fingerprints shall be checked against the | ||||||
12 | fingerprint records now and hereafter filed in the Department | ||||||
13 | of State Police and Federal Bureau of Investigation criminal | ||||||
14 | history records databases. The Department of State Police shall | ||||||
15 | charge a fee for conducting the criminal history record check, | ||||||
16 | which shall be deposited in the State Police Services Fund and | ||||||
17 | shall not exceed the actual cost of the State and national | ||||||
18 | criminal history record check. The Department of State Police | ||||||
19 | shall furnish, pursuant to positive identification, all | ||||||
20 | Illinois conviction information to the Department of Insurance | ||||||
21 | and shall forward the national criminal history record | ||||||
22 | information to the Department of Insurance. ".
