HOUSE BILL No. 1051



    A BILL FOR AN ACT to amend the Indiana Code concerning natural and cultural resources.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 2-5-31; (11)HB1051.1.1. -->     SECTION 1. IC 2-5-31 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]:
     Chapter 31. Versailles Lake Task Force
    Sec. 1. As used in this chapter, "task force" refers to the Versailles Lake task force established by section 2 of this chapter.
    Sec. 2. The Versailles Lake task force is established.
    Sec. 3. (a) The task force must examine the following topics:
        (1) The present and future use of Versailles Lake to meet the needs of the public water supply of the surrounding communities.
        (2) Options to increase the volume of water in Versailles Lake, including transforming Versailles Lake into a reservoir.
        (3) Options to increase and enhance the recreational opportunities and fish and wildlife habitat at Versailles Lake.
        (4) Potential funding sources to pay for any recommended changes made to Versailles Lake.
    (b) The task force may examine any other topic related to Versailles Lake or the public water supply of surrounding communities.
    Sec. 4. (a) The task force consists of eleven (11) members appointed as follows:
        (1) Two (2) members of the general assembly consisting of:
            (A) one (1) member of the house of representatives who represents Ripley County, appointed by the speaker of the house of representatives; and
            (B) one (1) member of the senate who represents Ripley County, appointed by the president pro tempore of the senate.
        Each member appointed under this subdivision must be from a legislative district that includes part of Ripley County.
        (2) The director of the department of natural resources or the director's designee.
        (3) The director of the department of natural resources division of water or the director's designee.
        (4) The president of the Ripley County fiscal body or the president's designee.
        (5) The president of the Versailles town council or the president's designee.
        (6) The executive director of the Ripley County tourism bureau or the executive director's designee.
        (7) One (1) representative of the Natural Resources Conservation Service of the United States Department of Agriculture appointed by the governor upon the recommendation of the Natural Resources Conservation Service.
        (8) One (1) representative of a soil and water conservation district that was organized under IC 14-32, IC 13-3-1 (before its repeal), or IC 14-32-3 (before its repeal) and is located in the South Laughery Creek Watershed, appointed by the governor.
        (9) One (1) representative of a water utility that uses water from Versailles Lake, appointed by the governor.
        (10) One (1) representative of the United States Army Corps of Engineers appointed by the governor upon the recommendation of the commander of the Louisville District of the United States Army Corps of Engineers.
    (b) The member of the house of representatives appointed to the task force under subsection (a)(1)(A) shall serve as chairperson of

the task force until December 31, 2011.
    (c) The member of the senate appointed to the task force under subsection (a)(1)(B) shall serve as chairperson of the task force beginning January 1, 2012.
    Sec. 5. The task force shall meet at the call of the chairperson.
    Sec. 6. The task force shall do the following:
        (1) Conduct public meetings to hear testimony and receive written comments concerning the topics studied under section 3 of this chapter.
        (2) Develop recommendations based on information received at public meetings.
        (3) Develop proposed solutions to problems concerning the implementation of the task force's recommendations.
        (4) Issue and present a final report to the water resources study committee before September 1, 2012.
    Sec. 7. The task force shall make its report available to:
        (1) the members of the house natural resources standing committee and the senate natural resources standing committee; and
        (2) the public.
    Sec. 8. (a) The department of natural resources shall staff the task force.
    (b) State and local agencies and governmental units shall cooperate and provide information to the task force as requested by the chairperson.
    Sec. 9. Any official action of the task force, including the final report of the task force, must be approved by at least six (6) members of the task force.
    Sec. 10. (a) A member of the task force who is not a state employee is not entitled to the minimum salary per diem provided by IC 4-10-11-2.1(b). Each member is, however, entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    (b) Each member of the task force who is a state employee but is not a member of the general assembly is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of

administration and approved by the budget agency.
    (c) Each member of the task force who is a member of the general assembly is entitled to receive the same per diem, mileage, and travel allowances paid to legislative members of interim study committees established by the legislative council.
    Sec. 11. (a) Except as provided in subsection (b), per diem, mileage, travel allowances, and other expenses paid to task force members shall be paid from appropriations made to the department of natural resources.
    (b) Per diem, mileage, and travel allowances paid to task force members who are members of the general assembly shall be paid from appropriations made to the legislative council or the legislative services agency.
    Sec. 12. This chapter expires December 31, 2012.
