Synopsis: Plumbing consumer safety matters. Provides that: (1) whenever a plumbing inspector (inspector) conducts an inspection of a construction, alteration, or repair of a building or improvements, the inspector shall verify at each point of inspection that each person acting as a plumbing contractor or journeyman plumber holds a valid plumbing license; (2) if the inspector submits a report to the division of fire and building safety, the report must indicate whether the plumbing was performed by a licensed plumbing contractor or licensed journeyman plumber; and (3) if the report to the division indicates that plumbing was not performed by a licensed plumbing contractor or licensed journeyman plumber, the division shall notify the Indiana plumbing commission of the performance of the plumbing by someone other than a licensed plumbing contractor or licensed journeyman plumber. Requires a county, municipality, or township (unit) that issues a permit for the repair, alteration, or construction of a building or improvements to: (1) require compliance with the licensing requirements for plumbing contractors and journeyman plumbers; and (2) notify the plumbing commission if the unit has reason to believe that plumbing was not performed by a licensed plumbing contractor or licensed journeyman plumber.

HOUSE BILL No. 1305



    A BILL FOR AN ACT to amend the Indiana Code concerning professions and occupations.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 22-15-2-8; (13)IN1305.1.1. -->     SECTION 1. IC 22-15-2-8 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 8. (a) As used in this section "plumbing" means plumbing (as defined in IC 25-28.5-1-2) that is:
        (1) authorized by a permit; and
        (2) not exempt from the application of IC 25-28.5 under IC 25-28.5-1-32 or another law.
    (b) As used in this section, "plumbing contractor" has the meaning set forth in IC 25-28.5-1-2(2).
    (c) As used in this section, "journeyman plumber" has the meaning set forth in IC 25-28.5-1-2(3).
    (d) Whenever a plumbing inspector conducts an inspection at a site at which a building or other improvements are being repaired, altered, or constructed, the plumbing inspector shall verify at each point of inspection that each person acting as a plumbing contractor or journeyman plumber holds a valid plumbing license issued under IC 25-28.5.
    (e) If the plumbing inspector submits a report to the division concerning an inspection described in subsection (d), the report must indicate whether the plumbing was performed by a licensed plumbing contractor or licensed journeyman plumber.
    (f) If a report submitted to the division by a plumbing inspector indicates that plumbing was not performed by a licensed plumbing contractor or licensed journeyman plumber, the division shall notify the Indiana plumbing commission, in the manner prescribed by the commission, of the performance of the plumbing by someone other than a licensed plumbing contractor or licensed journeyman plumber.

     (b) As used in this section "plumbing" means plumbing (as defined in IC 25-28.5-1-2) that is:
        (1) authorized by a permit; and
        (2) not exempt from the application of IC 25-28.5 under IC 25-28.5-1-32 or another law.
    (c) As used in this section, "plumbing contractor" has the meaning set forth in IC 25-28.5-1-2(2).
    (d) As used in this section, "journeyman plumber" has the meanings set forth in IC 25-28.5-1-2(3).
    (e) When issuing a permit to repair, alter, or construct a structure or other improvements, a unit shall require compliance with the licensing requirements for plumbing contractors and journeyman plumbers under IC 25-28.5.

If a unit that issued a permit described in subsection (e) has reason to believe that plumbing was not performed by a licensed plumbing contractor or licensed journeyman plumber, the unit shall notify the Indiana plumbing commission, in the manner prescribed by the commission, that it has reason to believe that the plumbing was performed by someone other than a licensed plumbing contractor or licensed journeyman plumber.
