A HOUSE RESOLUTION urging the Legislative Council
to assign to an appropriate study committee the topic of
Indiana's 811 laws.
Whereas, So-called "811 laws" are designed to prevent
damage to property and injury to individuals by requiring
contractors conducting excavations to determine the location of
underground resources and utilities before beginning work with
the help of a statewide database of facility locations, created in
part using information provided by the utilities themselves; and,
Whereas, If utility companies do not correctly identify the
location of their underground facilities, the usefulness of
Indiana's 811 is mitigated, and contractors and members of the
general public may be at risk for injury: Therefore,
SECTION 1. That the Indiana House of Representatives urges the
Legislative Council to assign to an appropriate committee for interim study the topic of the effectiveness of Indiana's 811 laws, with particular focus on how current law may be modified to increase worker safety and ensure an equitable distribution of responsibility between contractors and utility providers for fulfilling the laws' requirements.
