Synopsis: Art therapists. Provides that an individual may not profess
to be a registered art therapist unless the individual holds and maintains
the credentialing administered by the Art Therapy Credentials Board.
Establishes a Class B misdemeanor for practicing art therapy without
the credentialing.
Effective: July 1, 2012.

ARTICLE 4.5. ART THERAPISTS
Chapter 1. Activity by Nonregistered Individuals
Sec. 1. As used in this article, "art therapy" means the use of the creative process, visual art media, and psychotherapeutic principles within the therapeutic relationship with a patient in the assessment and treatment of emotional, cognitive, psychosocial, physical, neurological, and developmental disorders in children, adolescents, adults, families, and other groups.
Sec. 2. (a) As used in the section, "practitioner" means a person that holds:
(1) an unlimited license, certificate, registration, or permit;
(2) a limited or probationary license, certificate, registration, or permit;
(3) a temporary license, certificate, registration, or permit; or
(4) an intern permit;
issued by a board regulating a profession or an occupation.
(b) This chapter does not prohibit a practitioner from performing art therapy functions if the practitioner is acting within the scope of the practitioner's license, permit, registration, or certificate.
Sec. 3. Except as provided in section 2 of this chapter, an individual may not:
(1) profess to be a registered art therapist or art therapist;
(2) use the initials "ATR", or any other words, letters, abbreviations, or insignia indicating or implying that the individual is a registered art therapist; or
(3) practice art therapy;
unless the individual holds and maintains the registration credentialing administered by the Art Therapy Credentials Board.
Sec. 4. An individual who knowingly, recklessly, or intentionally violates section 3 of this chapter commits a Class B misdemeanor.
