    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 16-21-10; (13)IN0274.1.1. -->     SECTION 1. IC 16-21-10 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]:
     Chapter 10. Immunization of Hospital Inpatients
    Sec. 1. This chapter applies to a hospital licensed under any of the following:
        (1) This article.
        (2) IC 16-22.
        (3) IC 16-23.
        (4) IC 16-23.5.

     Sec. 2. (a) Except as provided in section 3 of this chapter, if a patient is admitted to a hospital during the period beginning October 1 and ending February 1 of the following year, the hospital shall:
        (1) offer to administer to the patient; or
        (2) make available to be administered to the patient;
immunizations against the influenza virus.
    (b) Immunizations provided under this chapter must be in accordance with the recommendations established by the Advisory Committee on Immunization Practices of the United States Centers for Disease Control and Prevention that are in effect at the time the immunizations are provided.
    Sec. 3. A hospital is not required to provide or make available to the hospital's patients an annual immunization against the influenza virus if the state department determines that the necessary vaccine is not in adequate supply.
    Sec. 4. A hospital may not require a patient to receive an immunization.
