SENATE RESOLUTION


     MADAM PRESIDENT:

    I offer the following resolution and move its adoption:

    A SENATE RESOLUTION urging the legislative council to establish an interim study committee to study the issue of explosive materials regulations.

    Whereas, The National Fire Protection Association (NFPA) is a non-profit organization that develops various codes and standards;

    Whereas, The NFPA Explosive Materials Code (NFPA 495) sets the maximum allowable ground vibration levels and the maximum noise levels at any dwelling, public building, school, church, or commercial or institutional building adjacent to a blast site;

    Whereas, Indiana has fully incorporated the NFPA Explosive Materials Code. (See 675 IAC 26-3-1);

    Whereas, According to the NFPA and Indiana law the peak particle velocity (vibration) in a building adjacent to a blast site shall not exceed 1.25 in/sec;

    Whereas, According to the NFPA and Indiana law air overpressure (noise) shall not exceed 134 decibels in a building adjacent to a blast site;



    Whereas, Despite these regulations, noise and vibration from blast sites in Indiana have been disruptive to adjacent buildings;

    Whereas, Further study of explosive materials regulations is necessary to determine whether more stringent rules are necessary to regulate blast sites: Therefore,

Be it resolved by the Senate of the

General Assembly of the State of Indiana:


    SECTION 1. That the Legislative Council is urged to establish an interim study committee to review explosive materials regulations, and consider whether Indiana should implement standards more stringent than those written by the NFPA.
    SECTION 2. That the committee, if established, shall operate under the direction of the legislative council, and that the committee shall issue a final report when directed to do so by the council.
