An Act relative to consumer protection in energy facility siting.



                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

            SECTION 1.  Notwithstanding any general or special law to the contrary, the Commonwealth of Massachusetts is hereby prohibited from issuing any permits for new energy facilities approved by the Energy Facilities Siting Board that are located within 1 mile of a residence.  Said linear distance shall be measured from the outermost perimeter of such facility to the outermost point of the aforementioned zones; provided, however that any such facility in operation on January 1, 2009, shall not be subject to this act.
