An Act to establish a paint thinner take back program.



                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

 

Chapter 21C of the general laws, as appearing in the 2006 official edition is hereby amended by inserting, after section 6, the following new section:-

Section 6A.  Every retail outlet selling paint thinner shall, no later than June 30, 2010, install on the premises and maintain paint thinner retention facilities, properly sheltered and protected to prevent spillage, seepage or discharge of the paint thinner into storm or sanitary sewers or into the waters of the commonwealth.  Every such outlet shall be required to accept, at no additional charge, paint thinner in quantities not exceeding five gallons per day from any individual with sales receipts or other proof of purchase from such outlet.  Every such outlet shall periodically remove or have removed the accumulated paint thinner so as not to violate any water pollution control or other statute or regulation.
