HOUSE BILL No. 4107

January 18, 2011, Introduced by Reps. Pettalia, Rendon, Franz, Muxlow, MacMaster and Wayne Schmidt and referred to the Committee on Energy and Technology.

A bill to amend 1994 PA 451, entitled

"Natural resources and environmental protection act,"

(MCL 324.101 to 324.90106) by adding section 5519.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

Sec. 5519. (1) Notwithstanding any other provision of this

act, if an application for a permit under this part or any other

part of this act for a coal-fired electric generating plant is not

approved or denied within 6 months after the application is filed

and administratively complete, the application shall be considered

to be approved.

(2) Subsection (1) does not apply if and to the extent that it

is inconsistent with federal law.
