HOUSE BILL NO. 5020

September 20, 2023, Introduced by Rep. Schriver and referred to the Committee on Government Operations.

A bill to amend 1947 PA 336, entitled

"An act to prohibit strikes by certain public employees; to provide review from disciplinary action with respect thereto; to provide for the mediation of grievances and the holding of elections; to declare and protect the rights and privileges of public employees; to require certain provisions in collective bargaining agreements; to prescribe means of enforcement and penalties for the violation of the provisions of this act; and to make appropriations,"

(MCL 423.201 to 423.217) by adding section 10a.

the people of the state of michigan enact:

Sec. 10a. (1) A bargaining representative shall not use dues, fees, assessments, or other contributions collected from a public employee for a political purpose unless all of the following conditions are met:

(a) The public employee gives the bargaining representative explicit authorization, in writing, to use the public employee's dues, fees, assessments, or other contributions for a political purpose. A public employee's authorization must be made during the 35-day period described in subsection (2) and the authorization expires 1 year after the date it is made.

(b) The public employee has not revoked the public employee's authorization. A public employee may revoke the public employee's authorization at any time.

(c) The bargaining representative complies with subsection (2).

(2) Each year, a bargaining representative shall provide the public employees that it represents a 35-day period to make the authorization described in subsection (1). Before the 35-day period begins, the bargaining representative shall provide written notice to the public employees that it represents that includes all of the following information:

(a) The start date and end date of the 35-day period.

(b) A statement that a public employee may make an authorization described in subsection (1) only during the 35-day period.

(c) An accounting of the expenditures the bargaining representative made for political purposes during the immediately preceding 1-year period. The accounting must include the entity to which each expenditure was made and the purpose of the expenditure.

(3) As used in this section:

(a) "Expenditure" means that term as defined in section 3 of 1978 PA 472, MCL 4.413.

(b) "Lobbying" means that term as defined in section 5 of 1978 PA 472, MCL 4.415.

(c) "Lobbyist" means that term as defined in section 5 of 1978 PA 472, MCL 4.415.

(d) "Lobbyist agent" means that term as defined in section 5 of 1978 PA 472, MCL 4.415.

(e) "Political purpose" means any of the following:

(i) Support for or opposition to any of the following:

(A) A ballot question or ballot question committee as those terms are defined in section 2 of the Michigan campaign finance act, 1976 PA 388, MCL 169.202.

(B) A political committee, political party, or political party committee as those terms are defined in section 11 of the Michigan campaign finance act, 1976 PA 388, MCL 169.211.

(ii) Lobbying.

(iii) An expenditure to a lobbyist or lobbyist agent.
