HOUSE BILL NO. 5169

June 29, 2021, Introduced by Rep. Wozniak and referred to the Committee on Insurance.

A bill to amend 1956 PA 218, entitled

"The insurance code of 1956,"

(MCL 500.100 to 500.8302) by adding section 3157c.

the people of the state of michigan enact:

Sec. 3157c. (1) This section applies to a person that does both of the following:

(a) Renders treatment or rehabilitative occupational training to an injured person for an accidental bodily injury covered by personal protection insurance as described in section 3157.

(b) Submits a charge for the treatment or training for payment or reimbursement by a personal protection insurer.

(2) A person described in subsection (1) shall not claim and is not entitled to a lien against or reimbursement from any recovery in tort by the injured person that is allowed under section 3135 for any part of the charge for the treatment or training, including, but not limited to, any part of the charge that exceeds the amount payable under section 3157.
