1.1A bill for an act
1.2relating to state government; modifying former legislators' health insurance
1.3coverage; changing the calculation of legislators' salary for the Minnesota
1.4State Retirement System;amending Minnesota Statutes 2010, sections 3A.01,
1.5subdivision 10; 43A.27, subdivision 4; 352D.04, subdivision 2.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 3A.01, subdivision 10, is amended to read:
1.8    Subd. 10. Salary. (a) "Salary" means the regular compensation payable under law
1.9to a member of the legislature and paid to the person for service as a legislator.
1.10    (b) The term includes the monthly compensation paid to the member of the
1.11legislature and the per diem payments paid during prior to the end of the 2012 legislative
1.12term for a regular or special session to the member of the legislature.
1.13    (c) The term does not include per diem payments paid to a member of the legislature
1.14during a regular or special session after the start of the 2013 legislative term; per diem
1.15payments other than during the regular or special session; additional compensation
1.16attributable to a leadership position under section 3.099, subdivision 3; living expense
1.17payments under section 3.101; and special session living expense payments under section
1.183.103 .
1.19EFFECTIVE DATE.This section is effective the day following final enactment.

1.20    Sec. 2. Minnesota Statutes 2010, section 43A.27, subdivision 4, is amended to read:
1.21    Subd. 4. Retired judges; former legislators. (a) Retired judges or former
1.22legislators may elect to purchase coverage for themselves or their dependents at their own
1.23expense as provided in paragraphs (b) and (c).
2.1(b) A retired judge of the state Supreme Court, the Court of Appeals, a district
2.2court, a county court, a county municipal court, or a probate court may elect to purchase
2.3coverage provided persons listed in section 43A.24, subdivision 2, clause (c). The
2.4commissioner shall notify judges no later than the effective date of their retirement of their
2.5right to exercise the option provided in this subdivision. A retired judge must notify the
2.6commissioner or designee of the commissioner within 30 days after the effective date of
2.7retirement if the judge intends to exercise the option.
2.8(c) A former member of the legislature may elect to purchase coverage provided
2.9persons listed in section 43A.24, subdivision 2, clause (a). A former member must notify
2.10the commissioner or designee of the commissioner within 30 days after the last day of
2.11service as a legislator or within 30 days from the effective date of this section, whichever
2.12is later, if the member intends to exercise the option.
2.13EFFECTIVE DATE.This section is effective the day following final enactment.

2.14    Sec. 3. Minnesota Statutes 2010, section 352D.04, subdivision 2, is amended to read:
2.15    Subd. 2. Contribution rates. (a) The money used to purchase shares under this
2.16section is the employee and employer contributions provided in this subdivision.
2.17    (b) The employee contribution is an amount equal to the percent of salary specified
2.18in section 352.04, subdivision 2, or 352.045, subdivision 3.
2.19    (c) The employer contribution is an amount equal to six percent of salary.
2.20    (d) For members of the legislature, the contributions under this subdivision also must
2.21be made on per diem payments received during a regular or special legislative session, but
2.22may not be made on per diem payments received outside of during a regular or special
2.23legislative session that begins after January 1, 2013, on the additional compensation
2.24attributable to a leadership position under section 3.099, subdivision 3, living expense
2.25payments under section 3.101, or special session living expense payments under section
2.263.103 .
2.27    (e) For a judge who is a member of the unclassified plan under section 352D.02,
2.28subdivision 1, paragraph (c), clause (16), the employee contribution rate is eight percent
2.29of salary, and there is no employer contribution.
2.30(f) These contributions must be made in the manner provided in section 352.04,
2.31subdivisions 4, 5, and 6.
2.32EFFECTIVE DATE.This section is effective the day following final enactment.
