1.1A bill for an act
1.2relating to education finance; authorizing the voluntary realignment of the school
1.3district boundaries for Independent School District Nos. 152, Moorhead, and
1.42164, Dilworth-Glyndon-Felton.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. VOLUNTARY BOUNDARY ALIGNMENT; MOORHEAD AND
1.7DILWORTH-GLYNDON-FELTON.
1.8    Subdivision 1. Boundary realignment allowed. The school boards of Independent
1.9School District Nos. 152, Moorhead, and 2164, Dilworth-Glyndon-Felton, may realign
1.10their shared district boundaries according to the provisions of this section.
1.11    Subd. 2. Public meeting required. Before adopting the joint resolution authorized
1.12in subdivision 3, each school board must publish notice of the meeting considering the
1.13resolution to realign district boundaries. The notice must include a general description of
1.14the lands that will be affected by the proposed boundary alignment and the proposed date
1.15of the boundary realignment. No sooner than 30 days after published notice, each school
1.16board must hold a public meeting on the proposed boundary alignment and allow public
1.17testimony at that meeting. The notice must also be mailed to each property owner of record
1.18within the lands proposed for realignment at least 30 days prior to the public meeting.
1.19    Subd. 3. Resolution. After considering the testimony at the public meeting,
1.20the school boards of Independent School District Nos. 152, Moorhead, and 2164,
1.21Dilworth-Glyndon-Felton, may mutually adopt a written resolution realigning the districts'
1.22boundaries. The resolution must be adopted by December 31, 2014, and must contain
1.23a description of the property to be realigned, list the effective date of the boundary
1.24realignment, and state whether the existing bonded indebtedness on the taxable property
2.1to be realigned will be assigned according to Minnesota Statutes, section 123A.45,
2.2subdivision 6, paragraph (b) or (c).
2.3    Subd. 4. County auditor notified. After adoption of the resolution, each school
2.4board must provide a copy of the resolution to the county auditor. The county auditor may
2.5request any other necessary information from the school districts to affect the transfer
2.6of property between the school districts. The county auditor must notify each affected
2.7property owner of the boundary change.
2.8    Subd. 5. Report to Minnesota Department of Education. Upon adoption of
2.9the resolution, the school boards must submit a copy of the resolution to the Minnesota
2.10Department of Education.
2.11EFFECTIVE DATE.This section is effective the day following final enactment.
