AN ACT

To amend chapter 1, RSMo, by adding thereto one new section relating to state implementation of federal programs.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 1, RSMo, is amended by adding thereto one new section, to be known as section 1.380, to read as follows:

            1.380. 1. No state agency shall implement or expand a federal program that requires a cost, share, or continuation of the program once federal money terminates or that expends more than one million dollars annually for more than two consecutive years unless it is included and passed as part of the budget by the general assembly. Funds received in response to a governor-declared state of emergency or disaster shall be exempt from this provision.

            2. For the purposes of this section, “state agency” shall mean any department, division, board, commission, office or other agency of the state of Missouri, except for such departments, divisions, boards, commissions, offices, or other agencies of the state of Missouri that derive their authority from the constitution of the state of Missouri.
