AN ACT

To amend chapter 162, RSMo, by adding thereto one new section relating to dropout prevention and recovery.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 162, RSMo, is amended by adding thereto one new section, to be known as section 162.668, to read as follows:

            162.668. 1. There is hereby established a pilot program within the metropolitan school district to be known as the "Metropolitan District Dropout Prevention and Recovery Program". The program shall be administered by the department of elementary and secondary education. Grants shall be awarded in this section for three years and shall be renewable. The program shall be funded through appropriations to the metropolitan district dropout prevention and recovery program fund.

            2. For purposes of this section, the following terms shall mean:

            (1) "Department", the department of elementary and secondary education;

            (2) "Program", the metropolitan district dropout prevention and recovery program.

            3. Grantees shall be schools within the metropolitan school district, which may contract with organizations to provide program services as described in subsection 5 of this section. Grantees shall cooperate with the department to evaluate the program each year, with a goal of determining replicable results and best practices.

            4. The department shall accept applications during school year 2010-2011 to begin implementation of the program for the 2011-2012 through 2013-2014 school year.

            5. The program shall have the following characteristics and goals:

            (1) A focus on research-based behavior-change outreach strategies;

            (2) Establishing and maintaining close relationships with the school district, local churches, caring volunteers, and other nonprofit organizations;

            (3) Establishing and maintaining a referral system based on individualized assessment and continuous followup to assess progress;

            (4) Achieving and maintaining academic progress; and

            (5) Acquiring job skills and instilling a work ethic through volunteerism, job training seminars, and work experience with a stipend.

            6. The department shall promulgate rules and regulations necessary to implement this section by January 1, 2011. Any rule or portion of a rule, as that term is defined in section 536.010, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536 to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2010, shall be invalid and void.

            7. There is hereby created in the state treasury the "Metropolitan District Dropout Prevention and Recovery Fund" which shall consist of general revenue appropriated to the program. The state treasurer shall be custodian of the fund. In accordance with sections 30.170 and 30.180, the state treasurer may approve disbursements. Upon appropriation, money in the fund shall be used solely for the administration of this section. Notwithstanding the provisions of section 33.080 to the contrary, any moneys remaining in the fund at the end of the biennium shall not revert to the credit of the general revenue fund. The state treasurer shall invest moneys in the fund in the same manner as other funds are invested. Any interest and moneys earned on such investments shall be credited to the fund.

            8. Under section 23.253 of the Missouri sunset act:

            (1) The provisions of the new program authorized under this section shall automatically sunset six years after the effective date of this section unless reauthorized by an act of the general assembly; and

            (2) If such program is reauthorized, the program authorized under this section shall automatically sunset twelve years after the effective date of the reauthorization of this section; and

            (3) This section shall terminate on September first of the calendar year immediately following the calendar year in which the program authorized under this section is sunset.
