AN ACT

To amend chapter 195, RSMo, by adding thereto one new section relating to merchants requirement to maintain a list of suppliers for law enforcement purposes, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 195, RSMo, is amended by adding thereto one new section, to be known as section 195.600, to read as follows:

            195.600. 1. All merchants in this state shall be required to develop and maintain a current list of all the suppliers of products which are sold or otherwise available in their establishments.

            2. The list shall contain the following information for the supplier of each product:

            (1) The name of the supplier;

            (2) The address of the supplier:

            (3) The name of a contact person or registered agent for the supplier and that individuals phone number.

            3. Upon request from any law enforcement or drug enforcement officer or agency for supplier information on a specific product or products, the merchant shall immediately disclose to such officer or agency the information described in subsection 2 of this section.

            4. Any merchant who violates the provisions of this section shall for a first offense be fined five hundred dollars. For a second or subsequent offense the merchant shall be fined one thousand dollars. In addition, the business license of any merchant who has violated the provisions of this section ten or more times shall be subject to sanction.

            5. This section shall be enforced by the agency or entity designated by the municipality.
