AN ACT

To amend chapters 49, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, and 473, RSMo, by adding thereto twelve new sections relating to vacancies in county elected offices.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapters 49, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, and 473, RSMo, are amended by adding thereto twelve new sections, to be known as sections 49.021, 51.021, 52.011, 53.011, 54.011, 55.005, 56.011, 57.011, 58.021, 59.023, 60.011, and 473.731, to read as follows:

            49.021. Within thirty days of entering the duties of office of county commissioner as provided by law, each elected county commissioner shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county commissioner, shall serve with the same duties and responsibilities in the county commissioner's absence, and shall serve as interim county commissioner until the vacancy is filled as provided by law.

            51.021. Within thirty days of entering the duties of office of county clerk as provided by law, each elected county clerk shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county clerk, shall serve with the same duties and responsibilities in the county clerk's absence, and shall serve as interim county clerk until the vacancy is filled as provided by law.

            52.011. Within thirty days of entering the duties of office of county collector as provided by law, each elected county collector shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county collector, shall serve with the same duties and responsibilities in the county collector's absence, and shall serve as interim county collector until the vacancy is filled as provided by law.

            53.011. Within thirty days of entering the duties of office of county assessor as provided by law, each elected county assessor shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county assessor, shall serve with the same duties and responsibilities in the county assessor's absence, and shall serve as interim county assessor until the vacancy is filled as provided by law.

            54.011. Within thirty days of entering the duties of office of county treasurer as provided by law, each elected county treasurer shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county treasurer, shall serve with the same duties and responsibilities in the county treasurer's absence, and shall serve as interim county treasurer until the vacancy is filled as provided by law.

            55.005. Within thirty days of entering the duties of office of county auditor as provided by law, each elected county auditor shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county auditor, shall serve with the same duties and responsibilities in the county auditor's absence, and shall serve as interim county auditor until the vacancy is filled as provided by law.

            56.011. Within thirty days of entering the duties of office of county prosecuting attorney as provided by law, each elected county prosecuting attorney shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county prosecuting attorney, shall serve with the same duties and responsibilities in the county prosecuting attorney's absence, and shall serve as interim county prosecuting attorney until the vacancy is filled as provided by law.

            57.011. Within thirty days of entering the duties of office of county sheriff as provided by law, each elected county sheriff shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county sheriff, shall serve with the same duties and responsibilities in the county sheriff's absence, and shall serve as interim county sheriff until the vacancy is filled as provided by law.

            58.021. Within thirty days of entering the duties of office of county coroner as provided by law, each elected county coroner shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county coroner, shall serve with the same duties and responsibilities in the county coroner's absence, and shall serve as interim county coroner until the vacancy is filled as provided by law.

            59.023. Within thirty days of entering the duties of office of county recorder of deeds as provided by law, each elected county recorder of deeds shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county recorder of deeds, shall serve with the same duties and responsibilities in the county recorder of deeds's absence, and shall serve as interim county recorder of deeds until the vacancy is filled as provided by law.

            60.011. Within thirty days of entering the duties of office of county surveyor as provided by law, each elected county surveyor shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county surveyor, shall serve with the same duties and responsibilities in the county surveyor's absence, and shall serve as interim county surveyor until the vacancy is filled as provided by law.

            473.731. Within thirty days of entering the duties of office of county public administrator as provided by law, each elected county public administrator shall appoint a deputy to immediately fill any vacancy in such office by reason of illness, removal, refusal to act, resignation, or death. Any deputy appointed under this section shall meet the same requirements for holding office as the elected county public administrator, shall serve with the same duties and responsibilities in the county public administrator's absence, and shall serve as interim county public administrator until the vacancy is filled as provided by law.
