JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to article IV of the Constitution of Missouri, and adopting one new section relating to the prohibition of toll roads.




Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2012, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article IV of the Constitution of the state of Missouri:

            Section A. Article IV, Constitution of Missouri, is amended by adding one new section, to be known as section 30(e), to read as follows:

            Section 30(e). Nothing in this constitution shall be construed to authorize the highways and transportation commission or any state agency to conduct feasibility studies for, or to fund, design, acquire, construct, maintain, reconstruct, or operate, toll roads or toll facilities in this state, or to enter into any public-private partnership or other contractual agreement to engage in such activities for a toll road or toll bridge on any bridge that does not have a toll as of the effective date of this section.
