AN ACT TO REQUIRE NURSING FACILITIES TO MAINTAIN A REGISTRY OF REGISTERED NURSES EMPLOYED WITH THE FACILITY AND TO NOTIFY THE STATE BOARD OF HEALTH AND DEPARTMENT OF HUMAN SERVICES WHEN A REGISTERED NURSE LEAVES EMPLOYMENT WITH THE NURSING FACILITY; TO REQUIRE NURSING FACILITIES TO HAVE AT LEAST ONE REGISTERED NURSE AND THREE LICENSED PRACTICAL NURSES ON THE FULL-TIME STAFF OF THE FACILITY; TO REQUIRE NURSING FACILITIES TO POST IN A PROMINENT LOCATION IN THE NURSING FACILITY A COPY OF THE ANNUAL REPORT AND EVALUATION OF THE NURSING FACILITY BY THE STATE DEPARTMENT OF HEALTH, AND PROVIDE A COPY OF THE REPORT AND EVALUATION TO THE FAMILY OF EACH RESIDENT OF THE NURSING FACILITY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The State Board of Health shall adopt rules and regulations that require nursing facilities licensed under Section 43-11-1 et seq. to maintain a registry of registered nurses employed with the facility which shall be provided to the State Board of Health and the Mississippi Department of Human Services. The rules and regulations adopted by the board also shall require the nursing facility to provide notice to both the board and the department when a registered nurse leaves employment with the facility and the reason for departure from employment with the nursing facility.

     SECTION 2.  The State Board of Health shall adopt rules and regulations that require nursing facilities licensed under Section 43-11-1 et seq. to have at least one (1) registered nurse and three (3) licensed practical nurses on the full-time staff of the facility.

     SECTION 3.  The State Board of Health shall adopt rules and regulations that require nursing facilities licensed under Section 43-11-1 et seq. to post in a prominent location in the nursing facility a copy of the annual report and evaluation of the nursing facility by the State Department of Health, and provide a copy of the report and evaluation to the family of each resident of the nursing facility.

     SECTION 4.  This act shall take effect and be in force from and after July 1, 2012.
