House Bill 1585

AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF RANKIN COUNTY, MISSISSIPPI, TO ALLOW THE ERECTION OF ELECTRONIC GATES FOR THE PURPOSE OF ENCLOSING NEIGHBORHOODS, PROVIDED THAT THE GATES OPEN AUTOMATICALLY UPON APPROACH BY ANY MOTOR VEHICLE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1. (1)  The Board of Supervisors of Rankin County, Mississippi, is authorized, in its discretion, to allow the erection of electronic gates on county roads for the purpose of enclosing neighborhoods provided the gates open automatically upon approach by any motor vehicle without the use of the following:

          (a)  A key;

          (b)  A code; or

          (c)  Any other device.

     (2)  The erection of electronic gates, as authorized by this section, shall not be considered an obstruction to any public road provided the gates open automatically for any vehicle that approaches the gates.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
