House Bill 1675

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF OXFORD, MISSISSIPPI, TO EXPEND FUNDS, ESTABLISH, MAINTAIN, REPAIR AND OPERATE A FARMERS' MARKET; TO PROVIDE THAT THE GOVERNING AUTHORITIES MAY ALLOW THE OPERATION OF THE FARMERS' MARKET ON CITY-OWNED PROPERTY OR PROPERTY PROCURED FOR SUCH PURPOSE; TO AUTHORIZE THE CITY OF OXFORD'S PARK COMMISSION TO CONTRIBUTE FUNDS OR EMPLOY PERSONNEL TO MANAGE OR OPERATE THE FARMERS' MARKET; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of Oxford, Mississippi, may, in their discretion, expend funds from the city's general fund or from grants or other sources of funding of the city or that the city's Park Commission may receive, for the purpose of providing funds to be expended to establish, maintain, repair and operate a farmers' market and facilities to assist in the disposal and sale of farm and other food products in the interest of farmers, consumers and the general public.  

     (2)  In addition to the authority granted in subsection (1) of this section, the governing authorities of the City of Oxford are authorized to allow the farmers' market to operate on city-owned property that is suitable for such purposes, or the governing authorities of the city may procure property for such purpose. 

     (3)  The City of Oxford's Park Commission is authorized to contribute funds or employ personnel to manage or operate the farmers' market and facilities within the city; however, only the governing authorities of the City of Oxford shall be empowered to determine whether and where such farmers' market may be established or its operation terminated.  

     SECTION 2.  This act shall take effect and be in force from and after its passage.
