House Bill 798

AN ACT TO REQUIRE EACH CHANCERY CLERK TO MAINTAIN A WILL REGISTRY; TO AUTHORIZE ANY RESIDENT TO FILE A COPY OF HIS OR HER WILL WITH THE WILL REGISTRY; TO PROVIDE THAT THIS ACT SHALL NOT AFFECT THE VALIDITY OF ANY WILL; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Each chancery clerk shall maintain a will registry in the office of such clerk, in addition to any other duties required of the chancery clerk by law.  Any resident of a county may file a copy of his or her will in the will registry of the chancery clerk.  No chancery clerk shall file a copy of any will of a person who is not a resident of that county.  Notwithstanding any other provision of law to the contrary, this section does not in any manner affect the validity of a will.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2017.
