House Bill 997

(As Passed the House)

AN ACT TO AMEND SECTION 37-11-9, MISSISSIPPI CODE OF 1972, TO REQUIRE THE SCHOOL BOARD OF EACH SCHOOL DISTRICT TO ADOPT A POLICY REGULATING OUTDOOR SPORTS PRACTICES ON DAYS THAT THE HEAT INDEX EXCEEDS 95 DEGREES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  Section 37-11-9, Mississippi Code of 1972, is amended as follows:

37-11-9.  (1)  The school board of each school district shall adopt a policy prescribing regulations governing the outdoor practice by students of any athletic sport in which the schools in the district participate on any day that the heat index exceeds 95 degrees (95°) Fahrenheit, as determined by the National Weather Service.  The Mississippi High School Activities Association, Inc., shall adopt guidelines that must be followed by all school boards in the adoption of those policies.  These guidelines shall be consistent with policies used by the United States Armed Forces or recommended policies of the Centers for Disease Control and Prevention.

     (2)  The board of trustees of any school district is authorized and empowered to pay out of the athletic fund or funds obtained from athletic activities all of the actual medical expenses evidenced by itemized bills of account, for injuries sustained by any regularly enrolled student while participating in athletic activities considered a part of any sport that said school engages in as a part of any regularly scheduled athletic contest with other schools, to include any injury sustained in any contest scheduled by the proper school authorities and any required training preparatory thereto.

     (3)  In lieu of the payment set out subsection (2), and in the discretion of the board of trustees, the board is authorized and empowered to contract for hospitalization insurance designed to fully compensate students for actual medical expenses in such cases.  The payment of such hospitalization insurance shall be made from funds available as set out in subsection (2).

SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
