AN ACT TO AMEND SECTION 69-3-17, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR THE PREEMPTION OF ANY LOCAL ORDINANCE OR REGULATION IN CONFLICT WITH STATE AGRICULTURAL SEED LAWS AND REGULATIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 69-3-17, Mississippi Code of 1972, is amended as follows:
69-3-17. (1) The
duty of enforcing this article * * * is
vested in the commissioner * * *.
The commissioner may establish rules and regulations not inconsistent with * * * this article, * * *
may
employ such agents and persons * * *, and may make use of other employees of
the * * *
department * * * as deemed necessary for enforcement of
this article.
(2) This article and the regulations of the department are of statewide concern and occupy the whole field of regulation regarding the cultivation, harvesting, production, processing, registration, labeling, sale, storage, transportation, quarantine, distribution, notification of use, planting, or other use of seeds to the exclusion of all local regulations. Except as otherwise specifically provided in this act, no ordinance or regulation of any political subdivision may prohibit or regulate any matter relating to the registration, labeling, sale, storage, transportation, quarantine, distribution, notification of use, planting and use of seeds.
SECTION 2. This act shall take effect and be in force from and after its passage.
