Senate Bill 2362

AN ACT TO CREATE NEW SECTION 37-3-109, MISSISSIPPI CODE OF 1972, TO REQUIRE THE DEPARTMENT OF EDUCATION TO RESPOND TO ANY REQUEST FOR INFORMATION FROM A MEMBER OF THE SENATE OR HOUSE OF REPRESENTATIVES WITH THE REQUESTED INFORMATION WITHIN SEVEN DAYS OF SUCH REQUEST; TO REQUIRE THE DEPARTMENT TO ENSURE IT HAS PROPER STAFFING TO RESPOND TO SUCH REQUESTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 37-3-109, Mississippi Code of 1972:

     37-3-109.  The Department of Education shall promptly respond to any request for information from a member of the Senate or House of Representatives.  A member of the Senate or House of Representatives may request any information within the Department of Education's purview, including but not limited to, education programs, school statistics, employee salaries, school success, funding mechanisms or grant information.  The Department of Education shall provide the requested information within seven (7) days of such request.  The Department of Education shall ensure it has proper staffing to respond to such requests.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2023.
