AN ACT TO PROVIDE THAT THE DEPARTMENT OF HEALTH MAY ENTER INTO AGREEMENTS WITH HEALTH CARE ENTITIES TO CREATE A STATEWIDE ELECTRONIC HEALTH INFORMATION EXCHANGE; TO CREATE A PROGRAM UNDER THE STATE DEPARTMENT OF HEALTH TO PROVIDE FUNDS TO HEALTH CARE ENTITIES FOR STARTUP COSTS RELATED TO THEIR PARTICIPATION IN A STATEWIDE ELECTRONIC HEALTH INFORMATION EXCHANGE; TO PROVIDE FOR REQUIREMENTS FOR PARTICIPATION IN THE PROGRAM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Legislature finds the following:  The Department of Health may enter into agreements with private entities to create or implement a statewide electronic health information exchange, with the goal of allowing physicians, clinicians, health care facilities, and other health care providers to securely share critical patient information at the point of care and to improve health care quality, coordination and efficiency.

     SECTION 2.  (1)  Subject to appropriation from the State General Fund, the Department of Health shall create a program that provides funds to health care entities for startup costs associated with this health information exchange.

     (2)  The Department of Health, in cooperation with health care associations, shall develop and implement an application process for health care entities to apply for these funds.

     (3)  Funds distributed from this program shall not exceed Five Thousand Dollars ($5,000.00) per health care entity.  Health care entities shall only use these funds to cover startup costs related to implementing and using the state's health care information exchange.

     (4)  Eligible health care entities shall be approved for participation in the program on a first-come, first-served basis, with applications being reviewed on a rolling basis, provided that allocation of these funds be evenly distributed across the state's congressional districts.

     (5)  The Department of Health shall identify and partner with health associations to implement this program.  For each dollar of state funds appropriated from the General Fund for this program, the partnering entity shall commit and spend a matching dollar of nonstate monies towards this program.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2021.
