AN ACT TO AMEND SECTION 51-9-155, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE ZONING ORDINANCES AND REGULATIONS OF THE COUNTIES AND MUNICIPALITIES WITHIN THE PEARL RIVER VALLEY WATER SUPPLY DISTRICT SHALL SUPERSEDE THOSE OF THE DISTRICT; TO PROVIDE THAT THE PEARL RIVER VALLEY WATER SUPPLY DISTRICT MAY UTILIZE THE ZONING ORDINANCES AND REGULATIONS OF THOSE COUNTIES AND MUNICIPALITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 51-9-155, Mississippi Code of 1972, is amended as follows:

     51-9-155.  (1)  The provisions of any other law, general, special or local, except as provided in this article and in subsection (2) of this section, shall not limit or restrict the powers granted by this article.  The water supply district herein provided for shall not be subject to regulation or control by the Public Service Commission.

     (2)  (a)  The zoning ordinances and regulations of the counties and municipalities on lands within the Pearl River Valley Water Supply District shall supersede those of the district.  The governing authority of each county that is a part of the district and any municipality within that county may adopt, enact and enforce any zoning ordinance or regulation on district lands within the boundaries of the applicable county or municipality.

          (b)  The district is authorized to utilize the zoning ordinances adopted by any county or municipality within the district.

     (3)  The district may use the services of any such county or municipality building official for the purpose of processing zoning application building permits and other issues pertaining to zoning.

     (4)  The district shall not limit or restrict an ordinance or regulation or interfere with its enforcement.  The use of county or municipal zoning ordinances or regulations shall not authorize the district to make final decisions related to zoning.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
