     Exempts drugs for treatment of certain conditions from restrictive mechanisms under Medicaid, NJ FamilyCare, AIDS Drug Distribution Program, and PAAD and Senior Gold programs.

An Act concerning certain prescription drug benefits and supplementing Title 30 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  For persons eligible to receive drug benefits pursuant to the Medicaid program established pursuant to P.L.1968, c.413 (C.30:4D-1 et seq.), the AIDS Drug Distribution Program, and the NJ FamilyCare Program established pursuant to P.L.2005, c.156 (C.30:4J-8 et seq.), a preferred drug list, therapeutic substitution, prior authorization, or other restrictive mechanism implemented by law or regulation shall not apply to prescription drugs that are prescribed for the treatment of: HIV/AIDS, including HIV opportunistic infections; cancer; organ or tissue transplants; viral hepatitis; seizure disorders; hemophilia; and mental illness or a mental disorder that is included in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders.

 

     2.  For persons eligible for the "Pharmaceutical Assistance to the Aged and Disabled" program, P.L.1975, c.194 (C.30:4D-20 et seq.) or the "Senior Gold Prescription Discount Program," P.L.2001, c.96 (C.30:4D-43 et seq.), a preferred drug list, therapeutic substitution, prior authorization, or other restrictive mechanism implemented by law or regulation shall not apply to prescription drugs that are prescribed for the treatment of: HIV/AIDS, including HIV opportunistic infections; cancer; organ or tissue transplants; viral hepatitis; seizure disorders; hemophilia; and mental illness or a mental disorder that is included in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders.

 

     3.  This act shall take effect January 1, 2011, and if enacted after that date, shall be retroactive to January 1, 2011.

 

 

STATEMENT

 

     This bill provides that in the case of Medicaid, NJ FamilyCare, the AIDS Drug Distribution Program, the Pharmaceutical Assistance to the Aged and Disabled Program and the Senior Gold program, a preferred drug list, therapeutic substitution, prior authorization, or other restrictive mechanism implemented by law or regulation shall not apply to prescription drugs that are prescribed for the treatment of: HIV/AIDS, including HIV opportunistic infections; cancer; organ or tissue transplants; viral hepatitis; seizure disorders; hemophilia; and mental illness or a mental disorder that is included in the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders.

     The provisions of this bill will ensure that recipients of these programs continue to have access to the prescription drugs that are most appropriate and effective for the treatment of their conditions.
