     Requires Legislative approval of Port Authority of New York and New Jersey minutes.

An Act concerning the Port Authority of New York and New Jersey, supplementing Title 32 of the Revised Statutes and amending R.S.32:2-7, and authorizing the Governor, on behalf of the State of New Jersey, to enter into a supplemental compact or agreement with the State of New York supplementing the compact or agreement between the State of New Jersey and the State of New York dated April 30, 1921, as amended and supplemented, and authorizing the Governor to apply, on behalf of the State of New Jersey, to the Congress of the United States for its consent to such supplemental compact or agreement.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Governor is authorized to enter into a supplemental compact or agreement, on behalf of the State of New Jersey, with the State of New York supplementing the compact or agreement between the State of New Jersey and the State of New York dated April 30, 1921 creating the Port of New York Authority, as set forth in P.L.    , c.    (C.     ) (pending before the Legislature as this bill).

 

     2.    (New section)  Notwithstanding any other law to the contrary, the minutes of every meeting of the Port Authority of New York and New Jersey shall be simultaneously transmitted, prior to taking effect, to the Legislature of the State of New York and the Legislature of the State of New Jersey for review and approval.  The minutes shall not take effect for 10 days, exclusive of Saturdays, Sundays, or public holidays, following receipt by the presiding officers of the New York Senate, the New York State Assembly, the New Jersey Senate, and the New Jersey General Assembly of a copy of the minutes.

     If, within the 10 day period hereinabove prescribed, the Legislature of either state shall disapprove the minutes by adoption of a concurrent resolution to this effect by that Legislature, the minutes shall not take effect.  Any such concurrent resolution of disapproval shall set forth the reasons for disapproving the minutes and the recommendations of that Legislature thereon.  If neither Legislature acts within the prescribed period of time, the minutes shall be deemed approved by the Legislatures.

 

     3.    R.S.32:2-7 is amended to read as follows:

     32:2-7. The Governor shall, within 10 days exclusive of Saturdays, Sundays or public  holidays after the minutes shall have been so delivered, cause the same to be  returned to the port authority either with or without his veto on any action  therein recited as having been taken by any commissioner appointed from this  State .  If the Governor shall not return the minutes within said 10-day period,  any action therein recited shall have force and effect according to the wording  thereof, subject to Legislative disapproval as provided in section 2 of  P.L.    , c.    (C.    ) (pending before the Legislature as this bill).

     4.    The Governor is hereby authorized to apply on behalf of the State of New Jersey to the Congress of the United States for its consent to and approval of the amendments to this compact or agreement provided in P.L.    , c.     (C.   ) (pending before the Legislature as this bill), but in the absence of such consent and approval, the Port Authority of New York and New Jersey shall have all the powers the State of New York and the State of New Jersey may confer upon it without the consent and approval of Congress.

 

     5.    This act shall take effect immediately, but shall remain inoperative until the enactment into law of legislation substantially similar to P.L.    , c.     (C.   ) (pending before the Legislature as this bill) by the State of New York, but if such legislation shall have been enacted prior to the enactment of P.L.    , c.     (C.   ) (pending before the Legislature as this bill), this act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the Port Authority of New York and New Jersey to transmit the minutes of its meetings to the Legislatures of New York and New Jersey for review and approval.  Either Legislature, by concurrent resolution, may disapprove the minutes within 10 business days of receipt of the transmission.  If neither Legislature acts within the prescribed period of time, the minutes shall be deemed to be approved by each Legislature, subject to the Governor's veto pursuant to R.S.32:2-7.
