SYNOPSIS
Requires certain State departments, divisions, commissions, and authorities to consider use of green or blue roof in construction of certain new State buildings, facilities, and structures.

An Act concerning the construction of certain State buildings, facilities, and structures and supplementing Title 52 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. (1) Any State department, division, commission, or authority having authority to design, construct, or manage the construction of a State building, facility, or structure shall identify design standards and maintenance requirements and consider, to the extent feasible, the use of a green roof or a blue roof for any new building, facility, or structure having at least 15,000 square feet in total floor area that is to be constructed for the sole use of a State governmental entity after the effective date of this act. In this context, feasibility shall include both physical and fiscal concerns related to the design, installation, and maintenance of a green roof or a blue roof. Any such building, facility, or structure may also have solar panels, provided that the solar panels do not interfere with the functions of the green roof or blue roof.
(2) The requirements of this subsection shall be in addition to the requirements of P.L.2007, c.269 (C.52:32-5.3 et seq.).
b. The requirements of this section shall not apply to any building, facility, or structure for which a request for proposal for entering into a contract to design the building, facility, or structure has been issued prior to the effective date of this act.
c. As used in this section:
"Blue roof" means a roof constructed with mechanical controls that drain stormwater, including but not limited to gravel beds, perforated pipes, rooftop detention systems, or weirs, designed to improve stormwater management.
"Green roof" means a roof that includes, among other things, a growth medium and a vegetation layer of drought resistant and hardy plant species, designed to improve stormwater management.
"Solar panel" means an elevated panel or plate, or a canopy or array thereof, that captures and converts solar radiation to produce power, and includes flat plate, focusing solar collectors, or photovoltaic solar cells.
"State governmental entity" means the same as the term is defined in section 1 of P.L.2007, c.269 (C.52:32-5.3).
2. This act shall take effect on the first day of the 13th month following the date of enactment.
STATEMENT
The bill requires certain State departments, divisions, commissions, and authorities to identify design standards and maintenance requirements and consider the use of a green or blue roof in the construction of certain new State buildings, facilities, and structures.
The bill provides that any State department, division, commission, or authority having authority to design, construct, or manage the construction of a State building, facility, or structure must identify design standards and maintenance requirements and consider, to the extent feasible, the use of a green or blue roof for any new building, facility, or structure having at least 15,000 square feet in total floor area that is to be constructed for the sole use of a State governmental entity after the effective date of the bill.
The bill provides that feasibility, for purposes of considering the use of a green or blue roof, will be based on both the physical and the fiscal concerns related to the design, installation, and maintenance of a green or blue roof, and provides that any new State building, facility, or structure subject to the bill's requirements also may have solar panels, provided the panels do not interfere with the functions of the green or blue roof.
The bill provides that its requirements do not apply to a building, facility, or structure for which a request for proposal for entering into a contract to design the building, facility, or structure has been issued prior to the effective date of the bill, and are in addition to other statutory requirements that require State buildings to be designed and managed to meet standards for a high performance green building.
The bill defines a "green roof" as a roof that includes, among other things, a growth medium and a vegetation layer of drought resistant and hardy plant species, designed to improve stormwater management. The bill defines a "blue roof" as a roof constructed with mechanical controls that drain stormwater, including but not limited to gravel beds, perforated pipes, rooftop detention systems, or weirs, designed to improve stormwater management.
The bill takes effect on the first day of the 13th month next following the date of enactment.
