SYNOPSIS

     Requires notice to consumers of availability of pet health insurance.

An Act concerning pet health insurance and supplementing P.L.1941, c.151.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Any kennel, pet shop, shelter or pound licensed pursuant to the provisions of P.L.1941, c.151 (C.4:19-15.1 et seq.), or any other person engaged in the ordinary course of business in the sale of pets as defined by section 1 of P.L.1985, c.401 (C.4:22A-1), whether for profit or not for profit, who sells or offers for sale more than five pets in one year, shall provide written notice to a consumer regarding the availability of pet health insurance offered by insurers in this State pursuant to section 1 of P.L.1987, c.377 (C.17:46D-1).

     b.    The person shall provide the written notice to the consumer regarding the availability of the pet health insurance on a separately provided paper or other format that the consumer may retain, at the point-of-sale of the pet.

     c.     The written notice shall contain all information as prescribed by regulation by the Commissioner of Health and Senior Services, in consultation with the Commissioner of Banking and Insurance.  The notice may include, but shall not be limited to, contact information for insurers currently offering pet health insurance in this State, or for the Department of Banking and Insurance as a resource for providing further information about pet health insurance.

     d.    The Commissioner of Health and Senior Services, in consultation with the Commissioner of Banking and Insurance, shall promulgate rules and regulations in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), to effectuate the purposes of this section.

 

     2.    This act shall take effect on the first day of the fourth month next following the date of enactment.

 

 

STATEMENT

 

     This bill requires notice to consumers of the availability of pet health insurance.  Specifically, the bill requires that licensed kennels, pet shops, shelters and pounds, as well as other persons engaged in the ordinary course of business in the sale of pets, shall provide written notice to a consumer regarding the availability of pet health insurance offered by insurers in this State.

     The person shall provide the written notice on a separately provided paper or other format that the consumer may retain, at the point-of-sale of the pet.  The notice shall contain all information as prescribed by regulation by the Commissioner of Health and Senior Services, in consultation with the Commissioner of Banking and Insurance.  The notice may include, but shall not be limited to, contact information for insurers currently offering pet health insurance in this State, or for the Department of Banking and Insurance as a resource for providing further information about pet health insurance.
