SYNOPSIS
Provides for forwarding of criminal history record background check information among State agencies under certain circumstances.

An Act concerning criminal history record background check information and supplementing Title 52 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. As used in this act:
"License" means any State agency permit, certificate, approval, registration, charter or similar form of permission to engage in a profession, trade, business or occupation.
"State agency" means the Executive Branch of the State, including, but not limited to, any department, board, bureau, commission, division, office, council, agency, or instrumentality thereof.
2. a. An individual who has a license from a State agency and has undergone a criminal history record background check as a condition for licensure in which no criminal history record information disqualified that individual from being so licensed, may, if that individual applies for initial licensure with another State agency, request that such criminal history record information be forwarded to that State agency.
b. A State agency shall forward criminal history record information of any licensee to another State agency upon request of an applicant for a license as provided in subsection a. of this section.
3. This act shall take effect on the 90th day after the date of enactment.
STATEMENT
This bill provides that an individual who is licensed by a State agency and has undergone a criminal history record background check as a condition for licensure in which no criminal history record information disqualified that individual from being so licensed, may, if that individual applies for initial licensure with another State agency, request that such criminal history record information be forwarded to the second State agency. The bill also requires a State agency to forward criminal history record information of a licensee to another State agency as provided in the bill.
