     Extends increased fee for burial or removal, and transit permits.

An Act concerning burial or removal, and transit permit fees and amending R.S.26:6-17.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.26:6-17 is amended to read as follows:

     26:6-17. The State registrar shall be entitled to receive a fee of [$5] $15 for each burial or removal, or transit permit issued[; except that, on or after the effective date of P.L.2007, c.98 but before the first day of the thirty-seventh month following the effective date of P.L.2007, c.98, the State registrar shall be entitled to receive a fee of $15].  The State registrar shall deposit the proceeds from the fees into the New Jersey Electronic Death Registration Support Fund established pursuant to section 17 of P.L.2003, c.221 (C.26:8-24.2), and shall provide such amount from the fee, as the Commissioner of Health and Senior Services determines appropriate, to the local registrar who issued the permit.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill permanently extends the authorization provided under section 1 of P.L.2007, c.98 for the State registrar to collect a $15 fee for each burial or removal, or transit permit issued.  The revenues generated from this fee are used to fund operational costs associated with the New Jersey Electronic Death Registration Support System (NJ-EDRS).

     Under existing law, section 1 of P.L.2007, c.98, as of August 1, 2010, the $15 fee will revert to $5 (the original fee under R.S.26:6-17), which will significantly reduce the amount of revenue deposited into the NJ-EDRS Fund, established pursuant to section 17 of P.L.2003, c.221, to support the EDRS.  If the fees are not extended, the Department of Health and Senior Services will be unable to maintain the NJ-EDRS.
