     Provides for voluntary contributions through gross income tax returns to support victims of Hurricane Sandy.

An Act providing for voluntary contributions through gross income tax returns to support victims of Hurricane Sandy, supplementing chapter 9 of Title 54A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. There is established in the Department of the Treasury a special fund to be known as the "Hurricane Sandy New Jersey Relief Fund Transfer Account."

     b.    A taxpayer shall have the opportunity to indicate on the taxpayer's New Jersey gross income tax return that a portion of the taxpayer's tax refund or an enclosed contribution shall be donated to the "Hurricane Sandy New Jersey Relief Fund Transfer Account" in accordance with the provisions of section 1 of P.L.1999, c.21 (C.54A:9-25.14).

     c.     Any costs incurred by the Division of Taxation for collection or administration attributable to this section may be deducted from receipts collected pursuant to this section, as determined by the Director of the Division of Budget and Accounting in the Department of the Treasury.  The State Treasurer shall transfer net contributions collected pursuant to this section to the "Hurricane Sandy New Jersey Relief Fund Transfer Account."

     d.    The Legislature shall annually appropriate all monies deposited in the "Hurricane Sandy New Jersey Relief Fund Transfer Account" established pursuant to this section to the Hurricane Sandy New Jersey Relief Fund Inc.

     e.     Subsection b. of this section shall not apply to a taxable year ending after December 31, 2014 if in the previous taxable year costs incurred by the Division of Taxation for administration pursuant to subsection c. of this section exceed 25 percent of the monies collected pursuant to this section, or to a taxable year during which the Director of the Division of Consumer Affairs in the Department of Law and Public Safety certifies in writing to the State Treasurer that the Hurricane Sandy New Jersey Relief Fund Inc. is no longer registered with the Charities Registration and Investigation Section of the Division of Consumer Affairs.

 

     2.    This act shall take effect immediately and apply to taxable years ending on or after December 31, 2012.

 

 

STATEMENT

 

     This bill provides for voluntary contributions by taxpayers on gross income tax returns to support victims of Hurricane Sandy in this State.  Contributions collected under the provisions of this bill will be appropriated to the Hurricane Sandy New Jersey Relief Fund Inc, a 501(c)(3) non-profit charitable organization (pending final IRS approval) committed to rebuilding New Jersey. 

     The bill establishes a special fund in the Department of the Treasury, to be known as the "Hurricane Sandy New Jersey Relief Fund Transfer Account," to which all donations collected from voluntary contributions are deposited. The bill requires the Legislature to appropriate all funds deposited in the special fund to the Hurricane Sandy New Jersey Relief Fund Inc.

     This bill will not apply to a taxable year ending after December 31, 2014 if in the previous taxable year costs incurred by the Division of Taxation for administration of the provisions of this bill exceed 25 percent of the contributions collected pursuant to this bill, or to a taxable year during which the Director of the Division of Consumer Affairs in the Department of Law and Public Safety certifies in writing to the State Treasurer that the Hurricane Sandy New Jersey Relief Fund Inc. is no longer registered with the Charities Registration and Investigation Section of the Division of Consumer Affairs.

     Hurricane Sandy brought unthinkable devastation to parts of the Garden State, destroying homes, businesses and some of New Jersey's most identifiable icons. Governor Chris Christie and First Lady Mary Pat Christie organized Hurricane Sandy New Jersey Relief Fund Inc. to aid, comfort, and rebuild New Jersey.  This bill will help Hurricane Sandy New Jersey Relief Fund Inc. in its effort to rebuild New Jersey.
