SYNOPSIS

     Designates Atlantic City and Pleasantville, Atlantic County, as areas eligible for redemption of pinelands development credits.

An Act concerning regional growth influences in the pinelands area and amending and supplementing P.L.1979, c.111.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 8 of P.L.1979, c.111 (C.13:18A-9) is amended to read as follows:

     8.    a.  The goal of the comprehensive management plan with respect to the entire pinelands area shall be to protect, preserve and enhance the significant values of the resources thereof in a manner which is consistent with the purposes and provisions of this act and the Federal Act.

     b.    The goals of the comprehensive management plan with respect to the protection area shall be to:

     (1)   Preserve and maintain the essential character of the existing pinelands environment, including the plant and animal species indigenous thereto and the habitat therefor;

     (2)   Protect and maintain the quality of surface and ground waters;

     (3)   Promote the continuation and expansion of agricultural and horticultural uses;

     (4)   Discourage piecemeal and scattered development; and

     (5)   Encourage appropriate patterns of compatible residential, commercial and industrial development, in or adjacent to areas already utilized for such purposes, including areas outside the pinelands area, in order to accommodate regional growth influences in an orderly way while protecting the pinelands environment from the individual and cumulative adverse impacts thereof.

     c.    The goals of the comprehensive management plan with respect to the preservation area shall be to:

     (1)   Preserve an extensive and contiguous area of land in its natural state, thereby insuring the continuation of a pinelands environment which contains the unique and significant ecological and other resources representative of the pinelands area;

     (2)   Promote compatible agricultural, horticultural and recreational uses, including hunting, fishing and trapping, within the framework of maintaining a pinelands environment;

     (3)   Prohibit any construction or development which is incompatible with the preservation of this unique area;

     (4)   Provide a sufficient amount of undeveloped land to accommodate specific wilderness management practices, such as selective burning, which are necessary to maintain the special ecology of the preservation area; and

     (5) Protect and preserve the quantity and quality of existing surface and ground waters.

     2.    (New section)  a.  Within three months of the effective date of this act, the Pinelands Commission shall adopt a revision to the comprehensive management plan designating Atlantic City, Atlantic County, and Pleasantville, Atlantic County, as areas eligible for the redemption of pinelands development credits.

     b.    Within six months of the adoption of the revision to the comprehensive management plan pursuant to subsection a. of this section, the Pinelands Commission, the governing body of Atlantic City, the governing body of Pleasantville, and the Casino Reinvestment Development Authority, established pursuant to section 5 of P.L.1984, c.218 (C.5:12-153), shall conduct a joint public meeting for the purpose of providing information on the designation of Atlantic City and Pleasantville as pinelands development credit redemption areas, and receiving informal comments and recommendations from local public officials and other interested parties.  Within one month of the public meeting held pursuant to this subsection, the Pinelands Commission shall begin negotiations with the governing body of Atlantic City, the governing body of Pleasantville, and the Casino Reinvestment Development Authority to resolve any issues concerning the implementation of the pinelands development credit program in Atlantic City and Pleasantville.

     c.    Within nine months of the adoption of the revision to the comprehensive management plan pursuant to subsection a. of this section, the governing body of Atlantic City and the governing body of Pleasantville shall adopt any changes to their municipal master plans and local land use ordinances necessary to provide for the implementation of the pinelands development credit program in Atlantic City and Pleasantville.

     d.    Except as provided in this act, or as may be necessary to implement the provisions of this act, Atlantic City and Pleasantville shall not be subject to the provisions of P.L.1979, c.111, or the jurisdiction of the Pinelands Commission.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would designate Atlantic City and Pleasantville, Atlantic County, as areas eligible for the redemption of pinelands development credits.  This bill would require the Pinelands Commission, the governing bodies of Atlantic City and Pleasantville, and the Casino Reinvestment Development Authority (CRDA) to hold a public hearing on the issue of redeeming pinelands development credits in Atlantic City and Pleasantville, and to engage in negotiations to resolve any issues concerning the implementation of the pinelands development credit program in Atlantic City and Pleasantville.  This bill would also require the governing body of Atlantic City and the governing body of Pleasantville to revise their master plans and local land use ordinances to enable Atlantic City and Pleasantville to implement the pinelands development credit program.
