     Establishes Cyber Security Bureau within the Office of Homeland Security and Preparedness.

An Act establishing a Cyber Security Bureau and supplementing Title 52 of the Revised Statutes. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Legislature finds and declares that:

     a.     Cyberterrorism is characterized by the premeditated use of information technology to actively disrupt a computer system or network with the intention to cause harm or to further a social or political objective;

     b.    The act of cyberterrorism represents one of the greatest challenges to national security in this country because of the complex and technical nature of computer information systems and the ability of terrorists to initiate an attack on critical infrastructure from a remote location; 

     c.     As New Jersey's critical infrastructure increasingly relies on computer networks and information technology, it is imperative to combat the threat of cyberterrorism which may have the ability to disrupt the State's computer networks and ultimately jeopardize the State's critical functions, including law enforcement and public works; and

     d.    It is fitting and proper that the State of New Jersey establish a Cyber Security Bureau within the Office of Homeland Security and Preparedness with the purpose of actively protecting the State's computer networks, responding to cyber events, and promoting  cyber security awareness within the State.

 

      2.      a.  There is established a Cyber Security Bureau within the Office of Homeland Security and PreparednessThe Cyber Security Bureau shall be dedicated to the protection of the State's cyber  security infrastructure, including, but not limited to, the identification  and mitigation of vulnerabilities, deterring and responding to cyber events, and  promoting  cyber security awareness within the State. The bureau, in conjunction with the Office of Information Technology, shall be responsible for Statewide policies, standards, programs, and  services relating to cyber security and geographic information systems.  
      b.      The  Director of the Office of Homeland Security and Preparedness shall select from among his staff a Chief Cyber Security Officer of the State of New Jersey.   The chief officer is authorized to maintain, in electronic or paper formats, maps, geographic images, geographic data and metadata relating to the State's critical infrastructure.
      c.       The Chief Cyber Security Officer may request from any federal government or State and local government cooperation, assistance, services and data that will enable the bureau to properly perform or exercise any of its functions, duties and powers established under the provisions of this act.
      d.      The bureau, in conjunction with the Office of Information Technology, shall coordinate activities with private sector entities and not-for-profit groups regarding cyber incidents and potential cyber threats that could affect the operations and activities of this State's critical infrastructure.  
      e.       The Director of the Office of Homeland Security and Preparedness shall set forth guidelines necessary to implement the provisions of this act.

 

     3.    This act shall take effect on the first day of the seventh month following the date of enactment, but the Director of the Office of Homeland Security and Preparedness may take such anticipatory administrative action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill establishes a Cyber Security Bureau within the Office of Homeland Security and Preparedness.  The bill provides that the Cyber Security Bureau is to be dedicated to the protection of the State's cyber security infrastructure, including the identification and mitigation of vulnerabilities, deterring and responding to cyber events, and promoting cyber security awareness within the State.  The bureau is required to work in conjunction with the Office of Information Technology to establish Statewide policies, standards, programs, and services relating to cyber security and geographic information systems. 

     In addition, the bill requires the Director of the Office of Homeland Security and Preparedness to appoint a Chief Cyber Security Officer from among his staff.  The Chief Cyber Security Officer is authorized to maintain electronic data relating to the State's critical infrastructure, and to coordinate activities with private sector entities and not-for-profit groups regarding cyber incidents and potential cyber threats.
