     Prohibits sex offenders from using or possessing erectile dysfunction drugs; prohibits provision or sale of erectile dysfunction drugs to sex offenders.

An Act concerning sex offenders and supplementing chapter 7 Title 2C of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  It shall be a crime of the fourth degree for an person who has been convicted, adjudicated delinquent or found not guilty by reason of insanity of a sex offense as defined in N.J.S.2C:7-2 to possess or use any prescription drug to treat erectile dysfunction.

     b.  It shall be a crime of the fourth degree for a person to knowingly sell, give, transfer or otherwise provide a prescription drug to treat erectile dysfunction to a person who has been convicted, adjudicated delinquent or found not guilty by reason of insanity of a sex offense as defined in N.J.S.2C:7-2.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits the use of  and provision or sale to sex offenders of drugs to treat erectile dysfunction, such as Viagra and Cialis. 

     Under the bill's provisions, it is a crime of the fourth degree for a sex offender to possess or use any prescription drug to treat erectile dysfunction.

     The bill also makes it a crime of the fourth degree for a person to knowingly sell, give, transfer or otherwise provide a prescription drug to treat erectile dysfunction to a sex offender.
