SYNOPSIS

     Transfers $3 million from "New Jersey Brain Injury Research Fund" to "Traumatic Brain Injury Fund."

A Supplement to "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 2010 and regulating the disbursement thereof," approved June 29, 2009 (P.L.2009, c.68).

 

     Be It Enacted by the Senate and the General Assembly of the State of New Jersey:

 

     1.    The following language is added on page 99 of P.L.2009, c.68:

 

46 DEPARTMENT OF HEALTH AND SENIOR SERVICES

 

 

Notwithstanding the provisions of P.L.2003, c.200 (C.52:9EE-1 et seq.) to the contrary, $3,000,000 in available funds from the "New Jersey Brain Injury Research Fund" is transferred to the "Traumatic Brain Injury Fund," established pursuant to P.L.2001, c.332, (C.30:6F-5).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     A recent public hearing provided information that the "Traumatic Brain Injury Fund" has insufficient monies available to continue to provide services to all individuals that currently receive services.  The Division of Disability Services in the Department of Human Services is in the process of proposing rules that would result in either a reduction or the elimination of services to persons who currently receive assistance from the fund.

     The Governor has identified that $3,000,000 in monies available to the "New Jersey Brain Injury Research Fund" are not needed by the fund to support its activities.  This bill would transfer the $3,000,000 to the "Traumatic Brain Injury Fund" to enable the fund to provide needed services and avoid an immediate reduction or termination of services to persons who receive assistance from the fund while reducing services over time to enable the fund to operate within its existing revenues.
