SYNOPSIS

     Requires retail food stores to notify consumers of certain recalled food products.

An Act concerning recalled food products and supplementing Title 56 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Upon notification of a recall for a contaminated raw food product, the proprietor of a retail food store that sold or offered for sale the contaminated raw food product shall notify consumers of the recall.  The notification required by this section shall be provided on a sign, posted in a clear and conspicuous location in the retail food store for a period of not less than 30 days following notification of the recall.

     b.    As used in this section:

     "Raw food product" means any fresh food item including, but not limited to, fruit, vegetables, meat, poultry, and seafood.

      "Retail food store" means a place where food is sold for consumption off the premises.

     c. A proprietor of a retail food store who violates the provisions of this section shall be subject to a penalty of not less than $250 or more than $500 for a first offense, and not less than $500 or more than $1,000 for a subsequent offense, to be recovered in a civil action in a summary proceeding pursuant to the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.)

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires retail food stores to notify consumers of recalls for raw food products.  The bill provides that upon notification of a recall for a contaminated raw food product, the proprietor of a retail food store that sold or offered for sale the contaminated raw food product is to notify customers on a sign, posted in a clear and conspicuous location in the store, for at least 30 days following notification of the recall. For purposes of the bill, "retail food store" is defined as a place where food is sold for consumption off the premises.

     The bill further provides that a proprietor of a retail food store who violates the bill's provisions will be subject to a penalty of not less than $250 or more than $500 for a first offense, and not less than $500 or more than $1,000 for a subsequent offense.
