SYNOPSIS

     Allows owner of hotel in Atlantic City to lease portion to casino operator under certain circumstances.

An Act allowing the owner of a hotel in Atlantic City to lease a portion of the facility to a casino operator and supplementing the "Casino Control Act," P.L.1977, c.110 (C.5:12-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of the "Casino Control Act," P.L.1977, c.110 (C.5:12-1 et seq.), or any other law, rule, or regulation to the contrary, the owner of a hotel located within the city of Atlantic City that meets the definition of "hotel" or "approved hotel" in section 27 of P.L.1977, c.110 (C.5:12-27), except that it is not operated as a casino hotel facility under the "Casino Control Act," P.L.1977, c.110 (C.5:12-1 et seq.), may lease a portion thereof to be used as a casino, provided the lessee applies for and is granted a casino license to operate the casino portion of the hotel. The lessor shall not be required to be licensed as a casino and shall have no role in the conduct of casino gaming at the facility.  The lessee shall meet all of the criteria for licensure as a casino except that it shall not be involved in the operation of the hotel portion of the facility.

     Except as provided by this section, a person approved by the commission to operate a casino within such a hotel shall be responsible for complying with all other provisions of the "Casino Control Act," P.L.1977, c.110 (C.5:12-1 et seq.), with respect to all aspects of casino operations. The owner of the hotel shall be responsible for complying with all of the hotel and non-gaming provisions of the "Casino Control Act," P.L.1977, c.110 (C.5:12-1 et seq.).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     Under current law, a casino license is issued with respect to a single casino hotel facility that includes both a casino and a hotel. This bill would allow the owner of a hotel located in Atlantic City that meets the definition of "hotel" or "approved hotel" in the Casino Control Act, except that it is not operated as a casino hotel facility under the act, to lease to another person space in the hotel to be used as a casino.  The lessor will not be required to be licensed as a casino and would have no role in the conduct of casino gaming at the facility.  The lessee will be required to meet all of the criteria for licensure as a casino, except that it will not be involved in the operation of the hotel portion of the facility.
