     Applies building code of New York City to World Trade Center, requires fire safety inspections.

An Act providing for building code compliance and fire safety inspections at the World Trade Center, supplementing P.L.1962, c.8 (C.32:1-35.50 et seq.), and agreeing with the State of New York with respect thereto.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    This act shall be known as "The World Trade Center Safety Act."

 

     2.    Notwithstanding section 12 of P.L.1962, c.8 (C.32:1-35.61) or any other provisions of law, any and all construction, reconstruction, repair, reconditioning, or other work done by or on the behalf of the port authority, its lessees, or any other person holding any interest derived from the port authority to rebuild, replace, repair, or otherwise recondition any building, structure, edifice, or facility of the world trade center, as defined in section 2 of P.L.1962, c.8 (C.32:1-35.51), shall be done in full compliance with the building code of the city of New York pursuant to chapter 1 of title 27 of the administrative code of the city of New York, as amended from time to time and shall be classified, considered and treated in all pertinent aspects including, but not limited to, code enforcement, inspections, padlocks and the issuance of violations, as an entity within the legal jurisdiction of the New York city department of buildings and the New York city fire department to ensure the safe and legal use of the property.  The world trade center shall be subject to all rules and regulations and periodic inspections by fire safety representatives of the local fire service.  No certificate of occupancy shall be issued unless an affirmative action by the New York codes council authorizes such occupancy.

 

     3.    This act shall take effect upon the enactment into law by the State of New York of legislation having an identical effect with this act, but if the State of New York has already enacted such legislation, this act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that all work done by or on the behalf of the Port Authority of New York and New Jersey or any other person holding any interest derived from the Port Authority to rebuild, replace, repair, or otherwise recondition any building, structure, edifice, or facility of the World Trade Center shall be done in full compliance with the building code of the city of New York.  The World Trade Center shall be subject to all rules and regulations and periodic inspections by fire safety representatives of the local fire service.  No certificate of occupancy shall be issued unless an affirmative action by the New York codes council authorizes such occupancy.

     Because the Port Authority of New York and New Jersey is a bistate authority created by a compact between the two states, this bill will not take effect until the State of New York passes legislation having an identical with this bill.  However, if the State of New York has already passed such legislation, this bill shall become effective immediately.
