       AN  ACT  to  amend  the  state finance law, in relation to requiring the
         purchase of energy star  equipment  and  appliances  whenever  capital
         improvements are made
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The state finance law is amended by adding  a  new  section
    2  163-d to read as follows:
    3    S  163-D.  ENERGY  STAR  APPLIANCES;  REQUIRED. 1. NOTWITHSTANDING ANY
    4  OTHER PROVISION OF LAW TO THE CONTRARY, ENERGY STAR EQUIPMENT AND APPLI-
    5  ANCES SHALL BE PURCHASED WHENEVER  FUNDING  IS  DESIGNATED  FOR  CAPITAL
    6  IMPROVEMENTS FOR OR BY A STATE AGENCY, THE JUDICIARY, OR LEGISLATURE.
    7    2. FOR THE PURPOSES OF THIS SECTION, THE TERM "ENERGY STAR" SHALL MEAN
    8  A  DESIGNATION FROM THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY OR
    9  DEPARTMENT OF ENERGY INDICATING THAT A PRODUCT MEETS  THE  ENERGY  EFFI-
   10  CIENCY  STANDARDS SET FORTH BY THE AGENCY FOR COMPLIANCE WITH THE ENERGY
   11  STAR PROGRAM.
   12    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   13  have become a law.
