PAULIN, BUCHWALD, COOK, GALEF, GOTTFRIED, SIMON, RAIA, JAFFEE, PEOPLES-STOKES -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to requiring minors who are five years old to attend kindergarten instruction The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph c of subdivision 2 of section 3205 of the educa- 2 tion law, as amended by chapter 277 of the laws of 2017, is amended to 3 read as follows: 4 c. [The board of education of the Syracuse city school district, the5board of education of the city school district of the city of New York,6the board of education of the city school district of the city of7Rochester, the board of education of the city school district of the8city of Utica, the board of education of the city school district of the9city of Buffalo the board of education of the city school district of10the city of Cohoes, the board of education of the city school district11of the city of Watervliet, and the board of education of the city school12district of the city of Yonkers are hereby authorized to require minors13who are five years of age on or before December first to attend kinder-14garten instruction. However,] In each school district of the state, 15 minors who are five years of age on or before December first shall 16 attend kindergarten instruction, however, the provisions of this para- 17 graph shall not apply to: 18 (i) Minors whose parents elect not to enroll their children in school 19 until the following September. 20 (ii) Students enrolled in non-public schools or in home instruction. 21 § 2. This act shall take effect on the first of July next succeeding 22 the date on which it shall have become a law.
