       AN  ACT  to  amend the general business law, in relation to the reuse of
         wireless telephone numbers
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  1  of section 399-cc of the general business
    2  law, as added by chapter 655 of the laws of 2005, is amended to read  as
    3  follows:
    4    1.  (A)  No  person, firm, partnership, association, limited liability
    5  company, corporation, or other business entity  shall  obtain  from  any
    6  provider of wireless telephone service, as such term is defined in para-
    7  graph  (b) of subdivision one of section twelve hundred twenty-five-c of
    8  the vehicle and traffic law, any  wireless  telephone  numbers  for  the
    9  purpose  of  creating a directory of wireless telephone numbers, without
   10  first obtaining the prior authorization from  each  individual  wireless
   11  telephone  service  customer.    Such  customer's authorization shall be
   12  affirmatively obtained via verifiable means.
   13    (B)  NO  TELEPHONE  COMPANY  AS  DEFINED  IN  SECTION  THREE   HUNDRED
   14  NINETY-NINE-DD  OF THIS ARTICLE, AS ADDED BY CHAPTER FOUR HUNDRED EIGHT-
   15  Y-SEVEN OF THE LAWS OF TWO THOUSAND SIX, THAT  PROVIDES  WIRELESS  TELE-
   16  PHONE  SERVICE SHALL REASSIGN A PHONE NUMBER TO A CUSTOMER WITHOUT FIRST
   17  INFORMING SUCH CUSTOMER OF HOW RECENTLY A PHONE NUMBER WAS ASSIGNED TO A
   18  PREVIOUS CUSTOMER. IF SUCH PHONE NUMBER WAS USED WITHIN  THE  LAST  YEAR
   19  SUCH CUSTOMER SHALL HAVE THE RIGHT TO REQUEST A DIFFERENT PHONE NUMBER.
   20    S  2.  This  act shall take effect on the sixtieth day  after it shall
   21  have become a law.
